Notice of Action Taken
Exemption for Delta: Scheduled foreign air transportation of persons, property, and mail between: (1) Los Angeles, California, and Culiacan, Mexico; (2) Phoenix, Arizona, and Hermosillo, Mexico; (3) San Antonio, Texas, and Mexico City, Mexico; and (4) New Orleans, Louisiana, and Mexico City, Mexico.
The applicants state that the exemption authority will be used pursuant to a code-share arrangement whereby Delta will place its DL* code on AeroMexico operated flights and/or AeroMexico flights operated with aircraft wet leased from Aerolitoral, S.A. de C.V. d/b/a AeroMexico Connect.
Statement of Authorization for AeroMexico: Display Delta’s “DL*” designator code on AeroMexico operated flights and/or AeroMexico flights operated with aircraft wet leased from Aerolitoral.
AeroMexico holds the requisite underlying economic authority to serve the subject markets, as follows: Los Angeles-Culiacan (see Notice of Action Taken dated January 29, 2009, in Docket OST-2009-0026); Phoenix-Hermosillo (see Notice of Action Taken dated February 13, 2009, in Docket OST-1996-1303); San Antonio-Mexico City (see Notice of Action Taken dated December 30, 2008, in Docket OST-2005-23435); and New Orleans-Mexico City (see Notice of Action Taken dated December 3, 2008, in Docket OST-2008-0369).
We note that Aerolitoral holds the requisite statement of authorization to permit it to wet lease aircraft to AeroMexico on a long-term basis (see Departmental approval dated May 25, 2009, with respect to Aerolitoral’s request to renew the requisite authority, Undocketed).
